Welcome to A Rai of Sunshine Co. (“we,” “us,” or “our”). By accessing or using our website at www.araiofsunshineco.com or placing an order with us, you agree to be bound by these Terms of Service. Please read them carefully before purchasing.

1. About Our Business

A Rai of Sunshine Co. is a youth-owned, home-based bakery founded by Railyn “Rai” Holt. We specialize in handmade baked goods including cake jars, whole cakes, and pound cake loaves, shipped nationwide within the United States.

2. Eligibility and Agreement

By placing an order, you confirm that you are at least 18 years of age, or are a minor with the consent and supervision of a parent or legal guardian who agrees to these terms on your behalf. You agree to provide accurate, complete, and current information during the ordering process.

3. Products and Descriptions

All of our products are handmade in small batches. Product photos are representative and may vary slightly in appearance due to the handmade nature of our goods. Product availability is subject to change without notice. We reserve the right to limit quantities or discontinue any product at any time without liability.

4. ALLERGEN WARNING — READ BEFORE ORDERING

Our products are prepared in a home kitchen (not a certified allergen-free facility) that regularly handles the following allergens:

  • Wheat / Gluten
  • Dairy (Milk, Cream, Butter)
  • Eggs
  • Tree Nuts — specifically Pecans, which are present in Grandma Jo’s Key Lime cake jars and may be present in other products due to shared equipment

If you or anyone who may consume our products has a food allergy, intolerance, or dietary restriction of any kind, do not order without first contacting us directly. By placing an order, you expressly acknowledge that you have read this allergen warning and accept full responsibility for any allergic reactions or adverse health effects. A Rai of Sunshine Co. shall not be liable for any harm caused by allergens.

5. Orders and Payment

All orders are subject to availability and acceptance. We reserve the right to cancel or refuse any order for any reason. Prices are listed in US dollars and may change without notice. Payment is due in full at checkout. We are not responsible for errors in pricing and reserve the right to cancel orders placed at an incorrect price.

6. Flavor and Customization Selections

For assorted pack orders, flavor preferences must be specified in the Order Notes field at checkout. If no selections are provided, we will fulfill the order at our baker’s discretion. We are not responsible for substitutions, missing selections, or dissatisfaction resulting from incomplete instructions provided by the customer.

7. Shipping and Delivery

We ship nationwide via USPS. Estimated shipping times are not guaranteed. We are not responsible for delays, damage, or losses caused by USPS or other factors outside our control, including weather events or carrier errors.

You are solely responsible for providing a complete and accurate shipping address. We are not liable for packages that are lost, stolen, undeliverable, or delayed due to an incorrect or incomplete address. Reshipping fees will apply if a package is returned due to address error.

Our products are perishable. We strongly recommend ensuring someone is available to receive and refrigerate the package promptly upon delivery. We are not responsible for product quality if the package sits unattended after delivery.

8. All Sales Final — No Returns or Refunds on Food Items

Due to the perishable and handmade nature of our products, all sales are final. We do not accept returns, exchanges, or issue refunds on food products under any circumstances, except as described below.

If your order arrives visibly damaged in transit or there is a documented quality issue, you must contact us within 48 hours of the delivery timestamp at nowornever.crypto@gmail.com with your order number and clear photos of the item and packaging. We reserve the right to determine, at our sole discretion, whether a replacement or store credit is warranted. This does not apply to subjective taste preferences or flavor dissatisfaction.

9. Perishable Products — Storage Responsibility

Our baked goods contain no artificial preservatives and must be stored properly after receipt. A Rai of Sunshine Co. is not responsible for product quality if items are not stored or consumed per any included storage instructions or within a reasonable timeframe after delivery.

10. Limitation of Liability

To the maximum extent permitted by applicable law, A Rai of Sunshine Co., its owner, agents, and affiliates shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of our website, products, or services, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim, regardless of the form of action, shall not exceed the total amount you paid for the specific order giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

11. Disclaimer of Warranties

Our website and products are provided “as is” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be error-free, uninterrupted, or free of viruses.

12. Intellectual Property

All content on this website — including the A Rai of Sunshine Co. name and logo, product names, photos, copy, and graphics — is our exclusive property and protected by U.S. copyright and trademark law. Unauthorized reproduction, distribution, or commercial use of any content without our written consent is strictly prohibited.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the state in which A Rai of Sunshine Co. operates, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the courts of that jurisdiction.

14. Privacy

Your use of our website is also governed by our Privacy Policy. We do not sell your personal information to third parties.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes take effect upon posting with an updated date. Continued use of our website or placing an order after changes are posted constitutes acceptance of the revised Terms.
